RE: The classification of a woman’s articles from Turkey.

Dear Mr. Cox:

In your letter dated February 10, 2000, you requested a classification ruling. The items are being returned, as you requested.

The submitted item, designated as project 07502, consists of a woman’s bath wrap, turban and slippers constructed from 100% cotton woven terry fabric. The bath wrap covers the bust and extends to the knees. The wrap features a top edge with one-inch wide elastic, and a velcro-like strip for a closure.

The open heeled soft textile slipper has a cotton cloth upper, a separately sewn on terry cloth fabric outer sole and a soft, flexible plastic foam midsole.

The terry cloth turban is placed on the head, twisted and closed with a button and loop to form a turban.

The applicable subheading for the bath wrap will be 6208.91.1010, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s...bathrobes, dressing gowns and similar articles: of cotton. The rate of duty will be 7.9 percent ad valorem.

The applicable heading for the slippers will be 6405.20.30, Harmonized Tariff Schedule of the United States (HTS), which provides for footwear, in which the outer sole’s external surface is not predominately rubber, plastics, leather or composition leather; in which the upper’s external surface is predominately textile materials; in which the largest fabric of the upper, consists, by weight, predominately of vegetable fibers such as cotton or flax (linings, accessories and reinforcements not included); and which has a line of demarcation between the sole and the upper. The rate of duty will be 7.5% ad valorem.

The applicable subheading for the turban will be 6505.90.2060, Harmonized Tariff Schedule of the United States (HTS), which provides for hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric, in the piece (but not in strips), whether or not lined or trimmed: Other: Of cotton, flax or both: Not knitted: Certified hand-loomed and folklore products; and headgear of cotton, Other. The rate of duty will be 7.7 percent ad valorem.

The bath wrap falls within textile category designation 350; the turban falls within textile category designation 359. Based upon international textile trade agreements, category 350 from Turkey is subject to a visa requirement and quota restraints.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
